1. Who you're contracting with
These Terms govern your use of CalmPath ("the Service"), provided by O2 XTUDIO LLC ("O2 XTUDIO", "we", "us", "our"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. The product
CalmPath provides the CalmPath book in digital (eBook) and physical (paperback, hardcover) editions, as well as the CalmPath Premium Membership (a recurring subscription giving access to bonus content and a members-only area).
3. Account and authority
You confirm you are of legal age in your country and, if buying on behalf of a business, you have authority to bind that business. You must provide accurate information, keep it up to date, and keep your login credentials confidential. You are responsible for activity under your account.
4. Acceptable use
You must not misuse the Service. In particular, you must not:
- use it for any unlawful, fraudulent, or abusive purpose;
- infringe anyone's intellectual property or other rights;
- upload malware, probe or scan the Service, or otherwise interfere with its security;
- scrape, harvest, or resell content or data from the Service.
5. Intellectual property
The Service, including the CalmPath book content, software, documentation, and branding, is owned by O2 XTUDIO LLC or its licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service and the content you purchase for personal, non-commercial use. You may not redistribute, resell, reverse engineer, or circumvent technical limits.
6. Payments, subscriptions, and refunds — Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Payment, billing, taxes, currency, cancellation, and refund mechanics are governed by Paddle's Checkout Buyer Terms. Recurring memberships renew automatically until cancelled. See our Refund Policy for details on requesting a refund.
7. Service availability
We work hard to keep the Service available, but we do not guarantee that it will be uninterrupted, secure, or error-free.
8. Disclaimers
To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. CalmPath's content is provided for general information and self-care purposes and is not a substitute for professional medical, psychological, or therapeutic advice.
9. Limitation of liability
To the fullest extent permitted by law, our aggregate liability arising out of or relating to these Terms or the Service will not exceed the fees you paid to us (via Paddle) in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability that cannot be excluded by law (such as for fraud, death, or personal injury caused by negligence).
10. Indemnity
You agree to indemnify O2 XTUDIO LLC against claims arising from your unlawful use of the Service, your breach of these Terms, or content you submit.
11. Suspension and termination
We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, suspected fraud or security risk, or repeated policy violations. On termination, your right to use the Service ends; sections that by their nature should survive will survive.
12. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date above will reflect any changes. Continued use of the Service after changes means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. Disputes will be resolved in the courts of Delaware, unless a mandatory consumer-law rule in your country of residence provides otherwise.
